A court-appointed neutral (CAN) is ethically neither fish nor fowl. A CAN who is a lawyer is pulled in multiple directions. First, as a lawyer, the CAN must comply with the Rules of Professional Conduct applicable to the jurisdiction in which the CAN is both licensed and performing the services as a neutral. Second, the CAN must comply with any ethics and other requirements contained in the appointment order from the court. Third, as a professional, the CAN must whenever possible comply with the aspirational codes, standards, and guidelines for the professional organization from which the appointment arises. Many, but not all, of these overlap—some may conflict. Regardless, the regulatory result is like a platypus: a mammal with a duck bill that lays eggs and nurses its young while having poisonous spikes on its hind legs that it rarely uses.
